Pack and Relax Rental Policy
DEPOSIT AND PAYMENTS: 50% of your reservation is due at time of booking. The total is due 60 days prior to your check in date. If you have a credit card on file it will be charged automatically unless other payment arrangements are made. Any requests to change credit card after the payment is processed will be subject to a fee equivalent to the processing fee imposed by the credit card processor. Please review your reservation and make sure all the information including occupancy and check in/check out dates are correct.
PAYMENT TERMS: Credit Cards, Electronic Funds or Electronic Checks are accepted. There is a $50 charge for all returned checks plus the cost of collection.
CANCELLATION: There is a $150.00 cancellation fee for any cancellation notification received more than 60 days prior to occupancy. There are no refunds if the reservation is canceled for any reason less than 60 days prior to the arrival date. Travel insurance is available for purchase during the booking process or at any time prior to the final payment for the reservation. Travel insurance is not refundable.
SEVERE WEATHER: We do not refund rents or deposits lost due to canceled or shortened stays because of weather. Travel insurance can be purchased during the booking process on packandrelax.com or any time prior to the final payment for the reservation. Guests must be aware that hurricane season is June 1 through November 30 and are advised to purchase travel insurance for this possibility.
RATES: Rates, terms and applicable taxes are subject to change without notice. We reserve the right to move in advance to a comparable property or refund the Guest the amount paid.
DAMAGE WAIVER: If applicable, the Damage waiver covers unintentional damages to the rental unit interior/exterior that may occur during your stay, provided they are disclosed to management prior to check-out. The waiver will cover a maximum benefit of $1,000. Any damages that exceed $1,000 will be charged to the credit card on file. CHECK IN AND CHECK OUT: The rental period begins at 4:00 p.m. on the day of arrival and terminates at 10:00 a.m. on the day of departure, unless prior arrangements have been made. Failure to vacate the rental unit will result in an hourly fee of $100. The properties are professionally cleaned and inspected before and after each rental to ensure that all guests have a clean and comfortable stay. Please be thoughtful of renters who may be checking in on the same day that you checkout. Occasionally delays may occur during peak seasons.
DAMAGE AND CLEANING ISSUES: Any damage or cleaning issues noticed upon arrival should be reported to the owner immediately. If damage or cleaning issues are not reported within 3 hours of your arrival, your credit card may be charged for the cost of the repair. All general maintenance issues should also be reported so the unit can be kept in good repair. You must contact Pack and Relax at the phone number and/or email address provided in your check in instructions to address any cleaning issues within 3 hours of your arrival. You will not incur any additional charges if the following items are adhered to:• No damage is done to the unit or its content including the linens.
• No items are missing upon the inventory check. (This includes, but is not limited to, transferring items to other units.)
• All debris, garbage and discards are placed in proper containers.
• All soiled dishes are placed in the dishwasher.
• There was no exceeding the maximum occupancy of the unit.
• There was no smoking or evidence of smoking.
• Unit is left in neat condition.
• Pet friendly units show no sign of pet damage or require excessive cleaning.
If you experience any problems whatsoever with the vacation property during your stay, please contact us immediately and we will do our best to rectify the matter as soon as it is practically possible. No action can be taken or liability accepted for any complaints received after the rental period has ended. Please note that as Florida is a tropical State, insects such as ants and the like are occasionally inevitable, and are not cause for complaint. The vacation property is treated periodically as part of a pest and termite control program, and is cleaned after each rental.
EQUIPMENT FAILURES: Any failure of equipment, including appliances, air conditioning and water heater, should be reported immediately. Every effort will be made to repair the issue
reported as quickly as possible, subject to the availability of repair contractors. Pack and Relax accepts no liability for inconvenience or loss that results from these type of failures.
NO SMOKING: Smoking is not allowed in or around any of our units. This includes decks, porches and balconies. If there is evidence of smoking in these areas, a fee of $500 will be charged to the credit card on file.
PETS (Allowed in Pet Friendly Units Only): Pets must be fully disclosed to Pack and Relax and are only allowed with prior approval and in Pet Friendly Units only. If a pet is brought into the unit without approval, a fine of $500 will be assessed, along with an additional cleaning fee of $150. This includes service pets. Guest pets must be treated for fleas and ticks prior to arrival.Guests must pick up after pets, tightly tie the remnants in a plastic bag and deposit waste in an outdoor receptacle if staying in a Pet Friendly Unit. Pets are not allowed on the furniture and all pet hair must be cleaned up prior to departure. An additional $150 fee will be charged if there is any report of pet hair on bedding and sofas. Guest is responsible for any damage made by their pets. Guest pets must be leashed at all times when outside of the unit. The violation of any terms of this pet policy subjects the guest to additional fines or termination of the rental period. Guest pet policies and unit availability are subject to change per County and association rules and regulations at any time.
COMMUNITY RULES: Guest agrees to abide by rules of the community. These may be posted in the unit or at the community pool or office and are provided as an attachment to check in instructions. These rules may change from time to time. Any fines or fees that are levied against the owner of the unit as a result of the guest's failure to abide by the community rules and regulations will be billed to the guest.
FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance deposit and/or rental money and the party will not be permitted to check-in. GUEST assures us that the tenants will observe all conditions and terms of this agreement as to maintaining the rental in good order and appearance and will conduct themselves in a manner inoffensive to neighbors. GUEST assures that any tenant who violates any of the terms of this Agreement shall be immediately denied occupancy and shall remedy any damages or other expenses, which are caused by the tenant and/or the tenant's guest(s). GUEST agrees that any tenant who is found using drugs or allows others to use drugs on the premises will be immediately denied continued occupancy at these premises. GUEST and/or their guests shall not disturb, annoy, endanger, or inconvenience neighbors, nor use the premises for any immoral or unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance on or about the premises. GUEST agrees that during the term of this agreement and such further time as he/she occupies the premises, he/she will keep the rental clean and free of trash, garbage, and other waste; and all pipes, wires, glass, plumbing and other equipment and fixtures in the same condition as at the beginning of, or may put in during the term of the agreement, reasonable wear and tear and damage by unavoidable fire and casualty only exception. GUEST agrees to indemnify and save our company harmless from all liability, loss or damage arising from any nuisance or harm made or suffered on the premises by the GUEST, tenants, or guests or from any carelessness, neglect, or improper conduct of any persons entering, occupying or visiting the premises. We accept no responsibility or liability for any loss or damage or alteration to the terms of your reservation caused by events beyond our control, including but not restricted to war, terrorist activity, civil commotion, flight delays, or cancellations, airport closures, loss of luggage, adverse weather conditions, fire flood, or industrial dispute. We cannot accept any liability for failure of public supplies such as water, electricity, Internet or breakdown of the air conditioning system or appliances. Nor for the consequences of the action or omissions of persons who may control or supply main services, or any actions taken in the vicinity of the property reserved, by any authority over which there is no control. We cannot accept any liability for your personal safety during your vacation. It is particularly important that children are supervised at all times in and outside the vacation property. We assume no responsibility for accidents. You are reminded to exercise care as to your personal safety, and the safety of your companions. Whenever possible, valuables should be left secure and out of sight.
CREDIT CARD AUTHORIZATION: I understand and consent to the use of the credit card provided without original signature on the charge slip, that an email of this agreement will serve as an original, and that this Credit Card Authorization cannot be revoked and will not terminate until 90 days after the rental is vacated. Additional charges may include: unauthorized long distance telephone and cable TV charges; excessive cleaning fees; fees or fines resulting from non-compliance with community rules and regulations; damages beyond normal wear and tear and unreturned keys. 3/2026
The following lease provisions apply only to rentals at Indigo Reef Marina Homes in Marathon, Florida and are required by the Indigo Reef Marina Homes Homeowner’s Association:
1) Rules and Regulations. Guest agrees to abide by all rules and regulations contained herein and/or posted on the premises related to the Rental Property and Indigo Reef Marina Homes Community. Guest’s obligations include but are not limited to keeping the premises as clean and safe as the conditions of the premises permit and causing no unsafe or unsanitary conditions in the common area and remainder of the premises that Guest uses. Guests agree not to use the premises for any commercial activities or purpose that violates any criminal law or governmental regulation. Guest's breach of any duty contained in this paragraph shall be considered material and shall result in the termination of guest occupancy with no refund of any kind. The Indigo Reef Marina Homes community rules include but are not limited to:
• Only one boat (including Jet Ski’s, kayaks, etc) is allowed with this rental agreement. Boats docked in the dedicated Villa boat slip must fit entirely within the 35 foot long boat slip space, including all motors and bow appendages. No part of the boat or anything attached to the boat may extend past 35 feet in length.
• Boats must be insured and must be equipped with medium sized bumpers to protect the marina docks and other boats within the marina.
• Boats must be equipped with sufficient bumpers that protect the docks and other boats and bumpers must be out and on sides of boat before entering the marina waterways. • Boats cannot be wider than 10 ft and cannot have a draft greater than 3 feet.
• Boats must display a boat tag, provided upon your arrival, at all times.
• Boats which are too large or which do not have a displayed tag may be towed at the boat owner’s/renter’s expense.
• Only two personal vehicles are allowed with this rental agreement. RVs, motor homes and commercial vehicles are not allowed. Vehicles must display a parking tag at all times. Parking tags will be provided to you upon arrival. Vehicles which do not have a displayed parking tag may be towed at the owner’s/renter’s expense. • No trailers are allowed to enter the Indigo Reef Marina Homes at any time. DO NOT
DRIVE A TRAILER INTO THE INDIGO REEF MARINA HOMES COMMUNITY.
• Electric Vehicles cannot be charged on the property.
• Swimming, snorkeling, diving and physically entering the ocean water in the canals and waterway of the marina and around Indigo Reef Marina Homes Community is strictly prohibited and not allowed at any time. • Guest is responsible for all damages to other boats/vessels and to the dock caused by guest’s operation of a boat or the operation of a boat by any invitee of the Guest within the waterways of the marina and the marina.
2) List of Guests, Vehicles and Boat. Guests must provide a list of all occupants and pets along with contact information and list the vehicles and license plates and if bringing a boat, the make, model and size of the boat. A copy of the boat insurance must also be provided.
3) Pool. A community pool is provided at the Rental Property, it is maintained by the Indigo Reef Marina Homeowners Association and third party vendors. Misuse of the pool by the spilling of foreign substances into the pool, i.e. soap, shampoo, suntan or spf oils, glass or metal will result in a Service Call Charge at the sole discretion ofOwner/Manager and the Indigo Reef Marina Homeowners Association. Under no circumstances are pets allowed in pool. All pool rules must be followed. Violation of this provision shall be grounds for expedited eviction and forfeiture of all monies paid. Release and Indemnity. Guest also agrees to indemnify Indigo Reef Marina Homeowners Association and all other villa owners at Indigo Reef Marina Homes Community from and against liability for injury to Guest or any other person occupying or invited to the Rental Property and Indigo Reef Marina Homes Community resulting from any cause whatsoever including, but not limited to, injury sustained as a result of use of the premises, pool, exercise equipment, docks, common areas, stairs and walkways, etc. Termination for Breach. Owner/Manager or Indigo Reef Marina Homeowners Association may terminate this Agreement upon the breach of any of the terms hereof by Guest. Guest shall not be entitled to the return of any rental monies paid under the terms of this Agreement and shall vacate the Property immediately upon request of Owner/Manager or Indigo Reef Marina Homeowners Association. Release and Indemnity of All Claims. The Rental Property has access to recreational and water activities in the community pool and has expansive docks and borders with the ocean. Guest fully understands and acknowledges that outdoor recreational and water activities and oceans have inherent risks, dangers and hazards. Participation in such activities and/or use of the docks or boats within the marina may result in injury or illness including, but not limited to bodily injury, disease, strains, fractures, partial and/or total paralysis, death or other ailments that could cause serious disability. Guest agrees to fully release, indemnify and hold harmless the Indigo Reef Homeowners Association and all other villa owners within the Indigo Reef Marina Homes community and any and all of their agents, managers, employees, or contractors for any injury or damage caused by these activities, whether caused by the negligence of the Owner/Managers, the negligence of the participants, the negligence of others, accidents, breaches of contract, the forces of nature or other causes foreseeable or unforeseeable. Guest hereby assumes all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Owner/Managers or by any other person. Guest hereby voluntarily agrees to release, waive, discharge, hold harmless, defend and Indigo Reef Homeowners Association and all other villa Owner/Managers within the Indigo Reef Marina Homes community and any and all of their agents, managers, employees, or contractors from any and all claims, actions or losses for bodily injury, property damage, wrongful death,loss of services or otherwise which may arise out of my use of Rental Property facilities, equipment, or activities. Guest further assumes full responsibility for the actions of any and all persons whom he/she may allow to enter the property during the rental period and indemnifies Owner/Manager, Indigo Reef Homeowners Association and all other villa owners within the Indigo Reef Marina Homes community from any and all claims arising from such other persons.
